    SS No 266 15 7815 – this is to open a new case…here is the letter I just sent to the IRS to Ms Janice L Williams.

    Dear Ms Williams,

    I hereby protest the audit of my 2005 tax return. Both items which were on the audit were reported by me on the original…one I think was a $20,000 early distribution from an IRA and the other was the sale of my house which I owned for 2.5 years and any gain is exempt.

    BTW, I never received that $20,000….I don´t know who got it but I didn’t…but the IRS lady in Miami said it was reported so I had to report it. I called to the company and they have no record of my social security number.

    I do not have a copy of the return and I find it outrageous that the IRS does an audit but yet you, who are apparently in charge of collection, nor your boss Mr Falcone seems to be able to put your hands on it.

    I have also informed you that my 2005 and 2006 tax returns showed a total due me of $12,000, more or less. I was denied that refund because it was more than 3 years. But the IRS got my money !!

    I also hereby protest the manner in which I am being treated by the IRS. I have made it very clear that the lien on Helms Property has put a severe hardship on me as this is my only source of income.

    Despite my dispute all along of the 2005 audit, the IRS placed a lien on Helms Properties and has received $7,500 from them which is the money I need desperately to live. I have filed the Form 433 showing no income (because at this moment all of my income to the IRS) and my expenses.

    I am going further into debt every month and my lines of credit are about to limit out. Refunding this $7,500 would provide substantial relief. I hereby appeal to your sense of decency to refund that money immediately to the Helms Properties so that they can get it to me. Don´t make me jump through hoops to get money which you should have never taken int the first place…that is not fair.

    I have also informed you that we spoke with the bank and they will not lend us any money against our equity since we have no source of income.

    If you need anything further from me, please let me know. In the meantime, I will be contacting the Taxpayer´s Advocate office and sending them a copy of this letter as soon as I know who is assigned to my case.

    Since you will be out of the office until August 16th, I request that you forward this email to Mr Falcone in the hopes he can resolve this as soon as possible.
